Terms of Service

These Terms of Service (“Terms”) govern your use of Fillbook (the “Service”), operated by Hogan Investment Group LLC (“we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service.

2. The Service

Fillbook is software that imports, records, and analyzes your trade history and lets you journal and review your own trading. It is a tool, not a financial service. See our Disclaimer.

3. Accounts and security

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

4. Subscriptions, billing, and cancellation

Paid plans are billed in advance on a recurring basis through our third-party payment processor and renew automatically until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable. We will give notice of material price changes before they take effect.

5. Brokerage connections

If you connect a brokerage or aggregator, you authorize us to access your trade and account data on a read-only basis to provide the Service. You remain bound by your broker’s and any aggregator’s terms, and you are responsible for your own brokerage account. We do not place trades.

6. Not investment advice

The Service, including the AI Coach, is for educational and informational purposes only and is not investment, legal, or tax advice. We are not a broker-dealer or investment adviser. You are solely responsible for your trading decisions.

7. Acceptable use

You agree not to misuse the Service, including by reverse-engineering it, scraping it, interfering with its operation, accessing it without authorization, or using it to violate any law or any third party’s rights.

8. Intellectual property

The Service and its content (excluding your data) are owned by Hogan Investment Group LLC and protected by law. You retain ownership of your data; you grant us a limited license to process it solely to provide the Service.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service or any data or analytics will be accurate, uninterrupted, or error-free.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Hogan Investment Group LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY TRADING OR INVESTMENT LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnification

You agree to indemnify and hold Hogan Investment Group LLC harmless from claims arising out of your use of the Service or your violation of these Terms.

12. Termination

We may suspend or terminate access for any violation of these Terms. You may stop using the Service at any time.

13. Changes to these Terms

We may update these Terms; material changes will be posted here with a new effective date. Continued use means acceptance.

14. Governing law

These Terms are governed by the laws of the United States and the state in which Hogan Investment Group LLC is organized, without regard to conflict-of-laws principles.
